蔡磊胜诉造谣者,赔偿款用于帮助贫困渐冻症患者
4月2日,北京市中闻律师事务所发布通报,代理的渐冻症抗争者、前京东副总裁蔡磊诉许某及陈某网络侵权责任纠纷一案,经北京互联网法院审理,蔡磊胜诉。
The law firm noted that according to the court's investigation, defendants Xu and Meng, who operate the Weibo accounts '俊俏花猫 HrS' and '2024 重回汉唐', have been fabricating and spreading false rumors such as 'Zhai Lei is faking his illness', 'Zhai Lei is fraudulently donating', and 'Zhai Lei is falsely claiming his professional titles' since 2024 to gain attention and increase their followers. This behavior has severely infringed upon Zhai Lei's reputation and also had a negative impact on his public welfare activities dedicated to fighting against ALS.
The court found that the statements made by both defendants lacked factual basis and were clearly intended to defame Zhai Lei, thus constituting an infringement of his right to reputation. As a result, they must immediately cease the infringement, delete all defamatory content from their accounts, and publicly issue a sincere apology statement in the involved Weibo account, while also compensating Zhai Lei for mental distress and reasonable expenses related to the lawsuit.
Zhai Lei, who previously stated that he had to use legal means to defend his dignity and truth, announced that the compensation would be donated to poor ALS patients.
Zhai Lei, a former JD Group vice president, was diagnosed with ALS in 2019 and has devoted all his energy to researching and fighting against the disease. He established the ALS Charity Trust and built the world's largest ALS patient data platform and pathological sample library, promoting multiple cutting-edge research projects. In 2024, Zhai Lei publicly declared that he and his wife would donate another 100 million yuan to support ALS research, with the funds coming from his autobiography royalties and live-streaming income.
Last November 26, Zhai Lei stated in a post that the content about 'Zhai Lei claims he has only 3 to 5 years left to live' was misleading. His original meaning was: the average survival period for ALS patients is only 3 to 5 years. This is general clinical data about the disease, not a personal life assessment.
Recently, Zhai Lei revealed his current health status, indicating that even with four people helping him, he can no longer walk. His six-year battle against ALS has been like a long dream, making him forget the changing seasons and leaving him with a deep memory of human warmth and coldness.
