In this lecture, Teacher Wu from the Product Legal Department of Douyin Group, centering on the theme ofRights Protection and Legal Challenges in the AI Era, combined her front-line practical experience in platform compliance, risk control and copyright governance, systematically sorted out the development context, application scenarios of the AI industry and the transformation of the music industry, deeply analyzed the core legal issues such as copyright disputes of AI-generated content and sound rights protection, as well as typical domestic and foreign judicial cases, bringing a cutting-edge, professional and practical industrial law course to the teachers and students present.

吴老师首先从AI 产业三层金字塔结构(基础设施层、算法模型层、场景应用层)入手,解读了国内外 AI 技术发展差异、落地现状与商业模式,厘清了 AI 训练数据、生成内容、权利归属等核心法律边界。她强调,AI 已成为文化娱乐产业核心生产力,尤其在音乐创作、传播、消费全链路中,相关应用需在合法合规的授权框架下推进。

Starting from the three-tier pyramid structure of the AI industry (infrastructure layer, algorithm model layer, scenario application layer), Teacher Wu interpreted the development differences, implementation status and business models of AI technology at home and abroad, clarifying the core legal boundaries of AI training data, generated content and ownership of rights. She emphasized that AI has become the core productive force of the cultural and entertainment industry, especially in the whole chain of music creation, dissemination and consumption, and relevant applications must be promoted under a legal and compliant authorization framework.

在分析AI 时代音乐版权与法律挑战时,吴老师指出,当前行业存在训练数据授权不明、AI 生成物权属争议、AI 声音侵权频发、合理使用界定模糊等突出问题。她结合纽约时报诉OpenAI 案、Getty 图片版权侵权案、环球音乐等三大唱片公司诉 AI 音乐公司案、国内 AI 声音侵权首案、文生图版权第一案等典型判例,阐明了未经授权使用版权内容训练 AI、AI 克隆翻唱等行为的法律风险与责任认定,并详细讲解了 AI 音乐创作、平台内容审核、用户生成内容等场景的合规操作路径。

When analyzing the music copyright and legal challenges in the AI era, Teacher Wu pointed out that the current industry has prominent problems such asunclear authorization of training data,ownership disputes over AI-generated content,frequent AI sound infringements, andvague definition of fair use. She combined typical cases such as The New York Times v. OpenAI, Getty Images copyright infringement case, the three major record companies including Universal Music v. AI music companies, the first domestic AI sound infringement case, and the first text-to-image copyright case, clarified the legal risks and liability determination of using copyrighted content to train AI without authorization and AI cloning covers, and explained in detail the compliant operation paths of scenarios such as AI music creation, platform content review, and user-generated content.

吴老师还结合全球AI 治理规则与行业实践,重点解读了 AI 生成内容著作权认定、声音权等人格权保护、平台合规责任等核心规则,并引入 AI 幻觉责任认定、AI 音乐平台规则设计等前沿实务问题,展现了著作权法与人格权法在 AI 技术迭代中的适用困境与行业探索。她强调,平台与创作者需在技术创新、权利保护、用户诉求三者间寻找平衡,从数据授权、技术风控、协议约定等维度源头防控法律风险。

As a front-line legal expert deeply engaged in product compliance, platform governance and copyright risk control on the Douyin platform, Teacher Wu also focused on interpreting the core rules of copyright recognition of AI-generated content, protection of personality rights such as sound rights, and platform compliance responsibilities based on global AI governance rules and industry practices. She also introduced cutting-edge practical issues such as liability determination of AI hallucinations and AI music platform rule design, demonstrating the application dilemmas and industry exploration of copyright law and personality right law in the iteration of AI technology. She emphasized that platforms and creators should find a balance among technological innovation, rights protection and user demands, and prevent legal risks from the source through data authorization, technical risk control and agreement agreement.
